Vollzeitjob für Alleinerziehende nicht zwingend zumutbar

Alleinerziehenden kann nicht generell ab dem dritten Lebensjahr des Kindes eine ganztägige Berufstätigkeit zugemutet werden. Vielmehr können solche Mütter und Väter nach einer Trennung dann länger Unterhalt von ihrem Ex-Partner verlangen, wenn eine längere eheähnliche Gemeinschaft und ein gemeinsamer Kinderwunsch bestanden haben.
Dies geht aus einem Grundsatzurteil des Bundesgerichtshofes (BGH) zum neuen Unterhaltsrecht hervor. Laut BGH kann auch bei älteren Kindern für den betreuenden Elternteil eine so große Doppelbelastung entstehen, dass nur ein Teilzeitjob zumutbar ist. Die Entscheidung ist das erste höchstrichterliche Urteil nach dem neuen Unterhaltsrecht von 2008. (Aktenzeichen: Bundesgerichtshof XII ZR 109 /05)

Im konkreten Fall ging es um eine unverheiratete Mutter zweier sieben und zehn Jahre alter Kinder. Die Frau forderte von ihrem Ex-Partner gut 1300 Euro “Betreuungsunterhalt” pro Monat - was dieser unter Verweis auf das neue Unterhaltsrecht ablehnte. Der BGH verwies das Verfahren an das Oberlandesgericht (OLG) Düsseldorf zurück. Das OLG muss nun prüfen, ob der Umfang, in dem die Mutter selbst für ihren Unterhalt sorgen muss, nach dem Alter der Kinder gestaffelt werden kann.
